Please read these Terms of Service (“Agreement”, “Terms of Service”) carefully before using www.stretchdspace.com (the “Site”) operated by Limber LLC (dba Stretchd) (“us”, “we”, or “our”). This Agreement sets forth the legally binding terms for your use of the Site and Stretchd Services.

By accessing or using the Site in any manner, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, discontinue use immediately.

1. ACCOUNTS

You must create a valid Stretch*d account to access some features. You agree to provide accurate information and are solely responsible for all activity under your account. Notify us promptly of any unauthorized use.

2. MEMBER SERVICES & POLICIES

Cancellations: Stretch*d enforces a 12-hour cancellation policy. Sessions canceled less than 12 hours prior to the appointment or no-shows are forfeited.

Personal Belongings: We are not responsible for lost, stolen, or damaged personal items.

Payments & Memberships:

• All sessions must be prepaid and are non-refundable.
• Memberships renew automatically and may be canceled up to 7 days before the next cycle.
• VISA, MasterCard, and American Express accepted.

Minors: No participants under 14. Ages 14–17 may participate with parental presence and written consent.

Health Disclosures: Consult a physician before participating. You release Stretch*d from any liability related to your health and safety by participating.

3. SPACE RULES

Stretch*rs are subject to change without notice. Please check our online schedule. You agree to abide by in-location rules for conduct, attire, and hygiene.

4. INTELLECTUAL PROPERTY

All Site content is owned or licensed by Stretchd and may not be copied, redistributed, or used without express written consent. This includes trademarks such as “Stretchd,” “Get Loose,” and all proprietary visuals.

5. MOBILE SERVICES

Standard messaging/data rates may apply for mobile interactions. By opting in, you consent to communications via SMS, MMS, or push notifications and understand these may be used for marketing unless opted out.

6. TERMINATION

We reserve the right to suspend or terminate access for violations of these Terms. Provisions that by nature survive termination will remain in effect.

7. THIRD-PARTY LINKS

We are not responsible for the content or practices of third-party sites linked on our Site. Review their policies separately.

8. GOVERNING LAW

This Agreement shall be governed by the laws of the State of New York, with rights and remedies also available under applicable California law for CA residents.

9. ELIGIBILITY

The Site is not intended for individuals under 13. If you are a minor aged 13–17, you must have parental or guardian consent.

10. FEES

Fees are subject to change. If your membership is terminated due to a violation of these Terms, you are not entitled to a refund.

11. CONSUMER RIGHTS – CALIFORNIA & NEW YORK

California Residents (CPRA):

• You may request access, correction, or deletion of your personal information.
• You have the right to opt out of the sale or sharing of your personal information.
• You may limit the use of sensitive personal information.
• To exercise these rights, visit our Data Request Form or email: privacy@stretchdspace.com.

New York Residents:

• You have the right to transparency, data access, and correction.
• We do not sell personal data or use it in discriminatory ways.

12. ARBITRATION; CONSUMER EXCEPTIONS

Except where prohibited by law, any dispute will be resolved by binding arbitration under the rules of the American Arbitration Association. However, California and New York residents may bring qualifying claims in small claims court and are not required to waive class action rights where prohibited by law.

13. ENTIRE AGREEMENT

These Terms, our Privacy Policy, and any other published legal notices constitute the entire agreement.

Limber LLC (dba Stretch*d) values your privacy and is committed to full transparency in accordance with the California Consumer Privacy Act as amended by CPRA (2025) and the New York Privacy Act (2025).

1. INFORMATION WE COLLECT

We may collect:

• Personal Identifiers (Name, email, phone, address)
• Payment Information (processed by third parties)
• Device/Usage Data (IP address, browser, device type)
• Location data (if permission granted)
• Health or wellness-related notes voluntarily submitted

We do not sell or trade personal data.

5. CHILDREN’S PRIVACY

6. THIRD-PARTY PROVIDERS

Payment processors and booking systems (e.g., Zenoti) may collect data independently. Their policies apply separately.

7. SECURITY

We use encryption, access controls, and secure hosting to protect your data.

8. CHANGES TO THIS POLICY

We may update this policy. The date at the top reflects the most recent revision. Continued use of the Site constitutes agreement.
